If a project-specific agreement conflicts with these general Terms & Conditions, the project-specific agreement will control with respect to that project.

You may request an estimate through our website, by telephone, by email, by text message, or through another communication method made available by Diaz Painting, Inc.

Submitting an estimate request, contact form, appointment request, photograph, project description, or other inquiry does not create a contract or guarantee that Diaz Painting, Inc. will accept, schedule, or perform the requested work.

Information provided during the estimate process is used to evaluate the requested services, property conditions, scheduling needs, and other project requirements.

Diaz Painting, Inc. may request additional information, photographs, measurements, access to the property, or an on-site evaluation before preparing or finalizing an estimate.

A project becomes subject to binding contractual obligations only after the applicable estimate, proposal, contract, work authorization, or other required project agreement has been accepted or executed as required by Diaz Painting, Inc.

3. Estimates and Pricing

Any general pricing information displayed on our website, in advertisements, or in other marketing materials is provided for informational purposes only unless specifically identified in writing as a binding offer.

If conditions are discovered that differ materially from the information available when the estimate was prepared, pricing, scope, scheduling, or other project terms may require revision.

The applicable written estimate, proposal, contract, change order, or other project-specific agreement issued or accepted by Diaz Painting, Inc. will control the pricing for that project.

4. Project Information Provided by Customers

Customers and prospective customers are responsible for providing accurate, complete, and reasonably current information concerning the property, requested services, project conditions, access requirements, scheduling needs, and other details relevant to the work.

Information provided by the customer may be used to prepare estimates, evaluate project requirements, schedule appointments, coordinate work, and communicate about the project.

Customers should disclose known conditions that may affect the work, including prior damage, leaks, moisture issues, repairs, coating failures, access limitations, hazardous conditions, or other property-related concerns.

Estimates, pricing, scheduling, project scope, or completion expectations may change if information provided to Diaz Painting, Inc. is incomplete, inaccurate, outdated, or if previously undisclosed conditions are later discovered.

Diaz Painting, Inc. may request additional information, photographs, measurements, documentation, or property access when reasonably necessary to evaluate or perform the requested services.

5. Existing Conditions

Accepted Answer

Painting, preparation, repair, and coating work may reveal existing or concealed conditions that were not visible, reasonably identifiable, or known before work began.

These conditions may include:

Water damage
Moisture intrusion
Rot
Mold or mildew
Cracking
Peeling or flaking coatings
Previous coating failure
Drywall damage
Stucco damage
Wood deterioration
Corrosion
Substrate failure
Structural defects
Improper previous preparation
Failed caulking or sealants
Other concealed or pre-existing property conditions

Diaz Painting, Inc. is not responsible for pre-existing defects, concealed conditions, or failures that were not caused by our work.

If previously undisclosed or concealed conditions are discovered, additional preparation, repairs, materials, labor, scheduling adjustments, or changes to the scope of work may be required.

Unless those items are already included in the applicable project agreement, additional work may require customer approval, a revised estimate, a change order, additional charges, or other written authorization before proceeding.

6. Color and Finish

Accepted Answer

Paint colors, finishes, and sheen levels displayed on websites, photographs, digital devices, printed materials, or electronic samples may differ from the appearance of the actual applied product.

Differences may result from lighting, photography, monitor or device settings, surrounding colors, surface texture, substrate conditions, sheen, application method, product formulation, and other factors.

Customers are responsible for reviewing and approving final paint colors, finishes, and sheen selections before application unless otherwise agreed in writing.

Once an approved color or finish has been applied, changes requested by the customer may result in additional labor, materials, scheduling adjustments, and charges.

Final appearance may also vary based on existing surface conditions and the characteristics of the selected coating product.

7. Scheduling and Availability

Accepted Answer

Requested dates, anticipated start dates, and estimated completion dates are subject to availability and may change based on project circumstances.

Scheduling may be affected by factors including:

Weather
Material availability
Customer-requested changes
Site conditions
Access restrictions
Other contractors or trades
Project complexity
Safety considerations
Required repairs or preparation
Delays in customer selections or approvals
Events outside the reasonable control of Diaz Painting, Inc.

Website appointment requests, estimate requests, and requested project dates are not guaranteed until confirmed by Diaz Painting, Inc.

Project-specific scheduling requirements and obligations will be governed by the applicable agreement between Diaz Painting, Inc. and the customer.

8. Changes to Work

Services requested outside the agreed scope of work may require additional authorization before the additional work is performed.

Changes may include additional surfaces, repairs, preparation, coatings, colors, materials, labor, access requirements, or other work not included in the original project scope.

Depending on the project, changes may require:

A written or electronic change order
A revised estimate or proposal
Additional customer authorization
Additional materials or labor
Scheduling adjustments
Additional payment

Project-specific change-order procedures and requirements will be governed by the customer's applicable agreement with Diaz Painting, Inc.

When you contact Diaz Painting, Inc. or provide contact information to us, you authorize us to respond using the contact information you provide for purposes related to your inquiry, estimate, appointment, project, invoice, payment, or customer-service relationship.

10. Photographs and Project Images

Customers may voluntarily provide photographs or videos for estimating, scheduling, project-management, documentation, or customer-service purposes.

Diaz Painting, Inc. may also photograph or document project conditions when reasonably necessary for estimating, project records, quality control, change-order documentation, or performance of the work, subject to applicable law and project agreements.

Submission of photographs or videos by a customer does not automatically grant Diaz Painting, Inc. permission to use those materials publicly for advertising, marketing, social media, portfolio, or promotional purposes.

Any authorization for promotional use of customer-provided photographs, project photographs, or videos may be addressed separately through project documentation or other consent.

11. Intellectual Property

Unless otherwise stated, website content including text, graphics, logos, photographs, design elements, service descriptions, and other original material is owned by, licensed to, or used with permission by Diaz Painting, Inc.
